For this reason, the government is expected to ratify the draft law on the Elimination of Sexual Violence to regulate sexual violence comprehensively. The goal of this study is to determine the evolution of data on sexual violence in Indonesia and to assess the urgency of ratifying the draft law on sexual violence elimination in light of the reality of the high number of sexual violence in Indonesia. This study employs a normative legal research method with statutory, conceptual, and case approaches. According to the findings of this study, sexual violence crimes continue to rise in a variety of forms, including not only physical contact but also non-physical contact. Several factors contribute to the high rate of sexual violence, including the structural readiness of institutions and human resources to deal with sexual violence crimes remains very low. Substantially, existing regulations have not comprehensively accommodated various forms of sexual violence, so there is no legality to serve as a foundation for preventing, dealing with, and recovering victims of sexual violence. 摘要

印度尼西亚大量性暴力的挑战性方面目前使《消除性暴力法草案》列入2021年国家立法方案优先事项。因此,政府将批准《消除性暴力法》草案,全面规范性暴力行为。这项研究的目的是确定印度尼西亚关于性暴力的数据的演变情况,并根据印度尼西亚性暴力数量众多的现实情况,评估批准消除性暴力法律草案的紧迫性。本研究采用规范的法律研究方法,包括成文法、概念法和个案法。根据这项研究的结果,性暴力犯罪以各种形式继续增加,不仅包括身体接触,也包括非身体接触。有几个因素导致性暴力发生率高,包括机构和人力资源在处理性暴力犯罪方面的结构性准备仍然很低。从本质上讲,现有的法规并没有全面适应各种形式的性暴力,因此不具备作为预防、处理和恢复性暴力受害者的基础的合法性。因此,作为减少和克服性暴力发生的社会控制手段,制定《性暴力犯罪法》(UU TPKS)是当务之急。
