First, the penal mediation concept in perspective of Islamic criminal law. By outlining penal mediation as an alternative to the settlement of a criminal case out of court through a voluntary agreement between the victim and the perpetrator, then, at least, it is in accord with the concept of qishash-diyat and its punishment. Second, the contribution of the core idea of mediation penal in perspective of Islamic criminal law is for criminal law reform in Indonesia. In a review of these studies, the core idea of mediation penal in Islamic criminal law perspective fulfills the philosophical, juridical, and sociological aspects, so that the criminal law reform led to the strengthening and optimizing the penal mediation as an alternative to the settlement of the criminal case. 摘要

这项概念研究是为了回顾两件事。首先,伊斯兰刑法视野中的刑事调解概念。通过将刑事调解概述为通过受害者和犯罪者之间的自愿协议在庭外解决刑事案件的替代方案,那么,它至少符合qishash diyat及其惩罚的概念。第二,伊斯兰刑法视野下的调解刑法核心思想对印尼刑法改革的贡献。在对这些研究的回顾中,伊斯兰刑法视角下的调解刑罚的核心思想满足了哲学、司法和社会学方面的要求,因此刑法改革导致了刑事调解作为刑事案件解决的替代方案的加强和优化。其核心思想是:(1)刑事调解的存在是印尼立法先行设立的必要条件;(2) 并非所有的刑事犯罪都可以通过刑事调解解决;(3) 双方参与刑事调解不存在胁迫因素;(4) 行为人与受害人或其家人商定的赔偿应直接给予受害人或其家属,而不是国家;以及(5)通过优化刑事调解来完成刑事案件,可以取消对犯罪人的惩罚。
