EnglishThe article addresses the question of whether the regulation of the crimes of negligent homicide and injuries, contemplated in the Chilean Criminal Code, satisfies the constitutional principle of legality in criminal law, established in the final subparagraph of article 19 n°3 of the Political Constitution. This article analyses the purpose of the principle of legality, as well as the requirements that it imposes over the legislator of criminal law. Then, it exposes and critically review the arguments of scholars who, in the context of German law, have proposed the unconstitutionality of the crimes of negligent homicide and injuries.
