摘要

在医疗纠纷数量、规模和强度不断增加的背景下,本文以追溯医疗领域的法律变迁为切入点,从法律视角来阐述医疗纠纷解决从立法导向到法制完善的变化。针对早期医疗领域的立法偏向于认定和处罚医生的责任,后来在平衡日益增多的“医患纠纷”现象与效果有限、难以遵纪守法之间的强化立法,本文借鉴国外法律经验,提出完善中国医患纠纷解决制度,减少对医生的司法追究。并在立法层面建立医生道歉的解决机制,促进医患关系的健康发展。
