THE CONCEPT AND PURPOSE OF LIQUIDATION OF A LEGAL ENTITY IN PRE-REVOLUTIONARY DOCTRINE

Целью исследования является выявление и анализ подходов дореволюционной доктрины к понятию ликвидации юридического лица. Основной задачей исследования выступило изучение литературных трудов, соответствующей судебной практики и положений законодательства с формулированием понятия лик- видации юридического лица и определением целей такой ликвидации. Автор сравнивает определения понятия «ликвидация юридического лица» в современной научной литературе с подходом дореволюционной доктрины. На основании изученных материалов автор предлагает определение ликвидации юридического лица, позволя- ющее отграничить ликвидацию юридического лица от сходных правоотношений. The purpose of the study is to identify and analyse the approaches of pre-revolutionary doctrine to the concept of voluntary liquidation of a legal entity. The main task of the research was to study literary works, relevant jurisprudence and provisions of legislation with the formulation of the concept of voluntary liquidation of a legal entity and the definition of the purposes of such liquidation. The author compares the definitions of the concept of «liquidation of a legal entity» in modern scientific literature with the approach of pre-revolutionary doctrine. Based on the studied materials, the author proposes a definition of the liquidation of a legal entity, which allows to distinguish the liquidation of a legal entity from similar legal relations.
