摘要

本研究分析了公证人/PPAT 的责任,以及针对当事人在买卖契约中提交虚假信息的公证人/PPAT 的法律保护力度。通过对法律规范的研究,本研究发现,PPAT 对其所做的契约负责,对当事人所传达的虚假信息的描述完全成为对陈述人的不完全答复,而 PPAT 对内部事务没有负责任的答复或不能就存在虚假信息所造成的损失提起不完全诉讼。根据 UUJN 第 66 条第(1)款的规定,公证人/PPAT 必须获得保护法和地区 MKN 的同意,因为在由公证人执行的案件中需要相关公证人/PPAT 的证词。
