摘要

普遍管辖权是一个尚未被世界各国普遍接受的定义,中国对这一定义的态度呈现出从拒绝接受到拒绝接受的转变。目前,国内普遍管辖权相关立法工作存在的问题是,权力来源主要依据国际习惯法和国内法,违反国际条约不可侵犯原则和违反犯罪合法原则。为适应国际犯罪审判的需要,与国际刑法相协调,维护中国的国家利益,中国应修改刑法总编第9条,明确普遍管辖权的适用范围,并在刑法专编中增设新的罪名,使国际刑法转化为国内法。
