INSTITUTIONALIZATION OF ADVISORY BODIES OF THE MINISTRY OF INTERNAL AFFAIRS OF RUSSIA

Введение: в статье раскрываются некоторые аспекты формирования совещательных органов в системе управления государством на различных этапах становления России, включая систему МВД России. Подчеркиваются особая роль и значение совещательных органов государственного управления, обладающих публично государственными полномочиями. При этом для органов внутренних дел эффективная организация управления имеет первоочередное значение в силу повышенной социальной значимости реализуемых правоохранительных задач. Автором проанализировано многообразие совещательных органов системы МВД России с особым акцентом на отсутствии правового регулирования организации их деятельности, подчеркнута необходимость институализации таких структур в МВД России. Материалы и методы: нормативную основу исследования составила правовая база Российской Федерации, регламентирующая правоохранительную деятельность МВД России. Эмпирической базой исследования выступили исторические источники становления и развития совещательных органов, нормативные правовые акты. В процессе исследования использовалась совокупность общенаучных и частнонаучных методов, таких как формально-логический, историко-правовой, сравнительно-правовой методы, а также метод теоретико-правового моделирования. Результаты исследования: рассмотрены отдельные этапы становления и развития совещательных органов государственного управления Российской Федерации. Исследованы факторы и условия создания совещательных органов; их развитие и унификация в государственном управлении и системе МВД России. Обсуждение и заключение: предложены выводы по совершенствованию правового регулирования деятельности совещательных органов системы МВД России. Обращено внимание на необходимость пересмотра подходов к их институализации. Introduction: the article reveals certain aspects of the formation of advisory bodies in the state management system at the stages of the formation of Russia, including the Ministry of Internal Affairs of the Russian Federation. The author highlights the special role and importance of the advisory bodies of any public administration structures, while for the internal affairs bodies of the Russian Federation, effective management organization is of primary importance. The author analyzes the diversity of advisory bodies of the Ministry of Internal Affairs of Russia paying attention to the lack of legal regulation of the organization of the activities of advisory bodies, emphasizes the need for institutionalization of such structures in the Ministry of Internal Affairs of Russia. Materials and Methods: the author used historical sources of the formation and development of advisory bodies, regulatory legal acts of the Russian Federation, the Ministry of Internal Affairs of the Russian Federation. General scientific methods were presented in the form of content analysis and theoretical and legal modeling. Results: certain stages of formation are considered and the development of advisory bodies of state administration of the Russian Federation. At the same time, one of the fundamental approaches was the analysis of the situation of these bodies. Factors and conditions of creation of advisory bodies are investigated; their development and unification in the state administration and the system of the Ministry of Internal Affairs of Russia. Discussion and Conclusions: the author of the article, based on the analysis of special literature, as well as a number of provisions of normative legal acts of the Ministry of Internal Affairs of Russia, proposed conclusions on improving the legal regulation of the advisory bodies of the Ministry of Internal Affairs of Russia. Attention is drawn to the need to revise approaches to the institutionalization of advisory bodies.
