摘要

生成型人工智能在大规模参与人类创造活动的同时,由于缺乏合理性,它既不能成为自然的人类主体,也不能成为拟人主体。但著作权法鼓励作品创作,在一定条件下,人工智能生成的内容有利于著作权法立法目的的实现,满足作品原创性的客观标准,因此具有著作权性。在此前提下,人工智能生成的内容版权归属问题需要讨论。目前,对其归属有设计者、使用者和所有者的观点。根据现行著作权法,人工智能生成内容的著作权原则上归用户所有,但在特殊情况下,除当事人另有约定外,归法人、用人单位、受托人等主体所有。
