Against this background, the problem studied in this research is how the position of customary law in the national legal system with a civil law pattern in Indonesia is. The research method used is normative juridical sourced from primary, secondary and tertiary legal materials. The results show that traces of customary law are scattered in legislation, as legal principles in positive law in Indonesia and also in jurisprudence. 摘要

印度尼西亚法律基本上来自四个法律来源,即习惯法、伊斯兰法、前殖民法和批准的国际条约。但令人难过的是,在这四种法律渊源中,习惯法被抛在后面或被遗忘了,与其他法律相比,习惯法显得低人一等。在科学论坛上,它只是用作研究材料和学术研究,并进行修辞叙述。在此背景下,本文研究的问题是习惯法在印尼大陆法系国家法律体系中的地位如何。使用的研究方法是规范性的法律来源,从一级,二级和三级法律材料。结果表明,习惯法的痕迹在立法中是分散的,作为印度尼西亚成文法的法律原则,在法理学中也是如此。研究发现,习惯法作为印尼立法的主要法律渊源,满足了现实和理想两个要求。
