The author proceeds from the dualistic nature of the domestic notaries, but considers it as a means of legal protection and protection of not only private, but also public rights and interests. It is shown that the state can act as a subject of not only public law, but also private law relations, without changing the fundamental principles of civil circulation. Emphasis is placed on the fact that participating in private law relations, the state, nevertheless, implements public interests. 摘要

本文分析了公证活动背景下的国家权益保护问题。笔者从国内公证员的二重性出发,认为公证员既是一种法律保护手段,也是一种既保护私人权益,又保护公共权益的手段。在不改变民事流转基本原则的前提下,国家既可以作为公法关系的主体,也可以作为私法关系的主体。重点是在私法关系中,国家仍然是公共利益的执行者。对国家参与的民法交易的公证问题进行了探讨,提出了完善现行立法的建议,包括确定国家参与的仲裁协议的强制性公证,将经过公证的调解协议作为拒绝接受索赔声明的依据,以及在诉讼程序中将经公证的交易作为“无可争辩的证据”的特殊地位。
