The method used in this study is a normative legal research method , where this method is used to find the appropriate concrete law to be applied to resolve a particular legal problem, the approach used is the Statute Approach and Conceptual Approach (Conceptual Approach). The results showed that in principle, the company may not carry out layoffs on unilateral workers in any situation, including in the health emergency situation. However, if the layoffs cannot be avoided in public health emergency situations due to the Covid-19 virus pandemic outbreak and still being done by the company, must be with certain reasons. 摘要

本研究的目的是分析商业行为者在Covid - 19大流行期间可以单方面照顾就业,以及因Covid - 19大流行而受就业影响的工人(PHK)的法律保护形式。本研究使用的方法是一种规范的法律研究方法,这种方法是用来找到合适的具体法律来解决特定的法律问题,使用的方法是规约方法和概念方法(Conceptual approach)。结果表明,原则上,在任何情况下,包括在健康紧急情况下,公司都不会对单方面的工人进行裁员。但是,如果由于新冠肺炎疫情的爆发,在突发公共卫生事件中无法避免裁员,而公司仍在进行裁员,那一定是有一定原因的。对被解雇劳动力的保护形式是:向工人和医务人员提供执业卡、奖励和薪金/工资援助、向UMKM提供重组信贷援助、给予THR。
