In a recent decision, the Vienna Higher Regional Court interpreted Austrian national law in conformity with the Consumer Credit Directive (in the light of the interpretation by the ECJ) and, therefore, argued in favor of a right of the consumer to a reduction of all costs of the credit in the event of early repayment of the credit. In another case, the Austrian Supreme Court requested a preliminary ruling of the ECJ regarding the interpretation of Art 25 para 1 of the Directive on credit agreements for consumers relating to residential immovable property. This leads to the question as to whether the same interpretation as in Lexitor is indicated. The article at hand discusses both court decisions and basic questions of the Univ.
