Since the Instructions of the Minister of Home Affairs Number 14 Year 1982 concerning the Prohibition of Absolute Power of Attorney as the Transfer of Land Rights took effect on 6 March 1982 and Government Regulation Number 24 Year 1997 concerning Land Registration took effect on 8 July 1997, the use of absolute power of attorney has been banned. But in the practice, the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land is still found. This is what often causes conflict because the use of absolute power of attorney is considered contrary to the laws and regulations in Indonesia. The formulation of the problem in this thesis is how the validity of the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land made by a public notary and how the legal consequences of the Binding Sale and Purchase Agreement of Land that use absolute power of attorney. The results of the study showed that regarding the use of absolute power of attorney in the Binding Sale and Purchase Agreement of Land is legal and does not violate the laws and regulations. 摘要

绝对授权书是由授权方出具的包含不可撤销要素的授权书。自从1982年第14号内政部长关于在土地权利转让时禁止绝对委托书的指示于1982年3月6日生效和1997年第24号关于土地登记的政府条例于1997年7月8日生效以来,已经禁止使用绝对委托书。但在实践中,在《具有约束力的土地买卖协议》中仍然存在使用绝对授权书的情况。这就是经常引起冲突的原因,因为在印度尼西亚,使用绝对授权书被认为是违反法律法规的。本文研究的问题是公证员在土地具有约束力的买卖协议中使用绝对授权书的效力如何,以及使用绝对授权书的土地具有约束力的买卖协议的法律后果如何。研究结果表明,在《土地具有约束力的买卖协议》中使用绝对授权书是合法的,没有违反法律法规。此外,在《有约束力的土地买卖协议》中使用本绝对授权书所产生的法律后果仍然被承认,并对订立该等协议的各方保持有效和约束力。
