It is of great importance not only for the creation and further devel-opment of the labour law, but also for its correct interpretation. The protective function of the labour law implies that, in contrast to other branches of the private law, the employer has substantially more obligations to-wards his/her employee. The employee “pays” for his/her above-standard social status in the employment relationship by the obligation of subordi-nation. Therefore, the labour-law relations are not characterised by equali-ty of subjects, as in other branches of the private law. Also the principle of freedom in the form of contractual freedom is significantly more tightened in the labour law than in other branches of the private law. 摘要

保护功能是劳动法的主导功能。这不仅对劳动法的创设和进一步发展具有重要意义,而且对劳动法的正确解释也具有重要意义。劳动法的保护功能意味着,与私法的其他部门相比,雇主对其雇员负有更多的义务。雇员通过从属义务为其在雇佣关系中的高于标准的社会地位“支付”。因此,劳动法关系不象私法的其他部门那样具有主体平等的特点。同样,契约自由形式的自由原则在劳动法中比在私法的其他分支中更为严格。第二部分分析了我国现行劳动法中存在的一些具体问题,特别是与新型数字化劳动形式的引入有关的问题,并提出了在立法实践中解决这些问题的途径。
