Formation and Development of the Institution of the Commissioner for Entrepreneurs’ Rights in the Russian Federation

В статье рассматриваются особенности развития института Уполномоченного при Президенте Российской Федерации по защите прав предпринимателей и уполномоченных по защите прав предпринимателей в субъектах Российской Федерации и их роль для современной России. Обосновывается то, что введение данного института – это новое и необходимое направление в свете обеспечения прав предпринимателей в России, поскольку конституционное право на свободу экономической деятельности, реализация экономических интересов и защита прав субъектов предпринимательства являются важными и приоритетными направлениями практически во всех государствах. Автор раскрывает особенности и деятельность уполномоченных по защите прав предпринимателей в субъектах Российской Федерации. На основе анализа различных подходов о понятии выделяются проблемные аспекты их деятельности. Анализируя понятие Уполномоченного при Президенте Российской Федерации по защите прав предпринимателей в Российской Федерации, автор приходит к выводу о том, даже не обладая реальными властными и распорядительными полномочиями в системе публичного администрирования, он является необходимым элементом в государственном механизме восстановления нарушенных прав предпринимателей. The article discusses development of the institution of the Commissioner for Entrepreneurs’ Rights under the President of the Russian Federation and commissioners for entrepreneurs’ rights in Russian subjects and their role for modern Russia. The article substantiates that the introduction of this institution is a new and necessary direction in the light of ensuring the rights of entrepreneurs in Russia, since the constitutional right to freedom of economic activity, realization of economic interests and protection of business entities’ rights are important and priority areas in almost all states. The author reveals features and activities of the authorized representatives for protection of entrepreneurs’ rights in subjects of the Russian Federation. Based on the analysis of various approaches to the concept, problematic aspects of their activities are highlighted. Analyzing the concept of the Commissioner for Entrepreneurs’ Rights under the President of the Russian Federation, the author comes to the conclusion that even without having real power and administrative powers in the system of public administration, the Commissioner is a necessary element in the state mechanism for restoring violated rights of entrepreneurs.
