The article focuses on the established decentralization course in Ukraine and the legislative consolidation of problematic issues of waste management at the local level, in particular, considers the Draft Law “On Waste Management” from 04.06.2020 № 2207-1-d. It is emphasized that the existence of an extensive system of regulations and legislation that establish the role of local authorities in waste management at the local level, although they contain a number of important provisions, and do not fully meet the needs of local communities, which is manifested in excessive accumulation of household waste and an unsatisfactory percentage of their processing. Using such general scientific research methods as: description, comparison, analysis, induction and others, the article compares the provisions of the Draft Law with the norms set forth in the Law of Ukraine “On Waste” and draws a clear conclusion that the provisions of the Project are more in line with modern realities. The main advantages of the Draft Law are the provision of a hierarchy of waste management, a municipal waste management system and the establishment of the obligation of direct participation of executive bodies of local councils in the implementation of state policy on waste management. 摘要

与家庭垃圾的产生和处理有关的问题在我国和其他国家变得越来越重要,因为垃圾是加剧全球变暖趋势的主要威胁之一。本文侧重于乌克兰既定的权力下放进程和地方一级废物管理问题的立法整合,特别是考虑2020年6月4日№2207-1-d的“废物管理法”草案。有人强调指出,存在一个广泛的规章和立法制度,确定地方当局在地方一级的废物管理方面的作用,虽然其中载有一些重要的规定,但并没有充分满足地方社区的需要,这表现在家庭废物的过度积累和其处理的百分比令人不满意。本文采用描述、比较、分析、归纳等一般科学研究方法,将法律草案的规定与乌克兰《废物法》规定的规范进行比较,得出项目规定更符合现代现实的明确结论。该法律草案的主要优点是规定了废物管理的等级制度、城市废物管理制度和规定地方议会的执行机构直接参与执行国家废物管理政策的义务。特别是,在乌克兰根据与欧盟的关联协议有义务将废物管理领域的国家立法与欧盟在该领域的法律相协调的背景下,给出了一些论点,根据2020年6月4日№2207-1-d的“废物管理法”草案比1998年3月5日№187/98-VR的现行乌克兰“废物”法更符合乌克兰现有的权力下放趋势。
