Preventive and Repressive Legal Protection actions, however, a problem or conflict of law arises which regulates the time limit which is the source of problems between the Mortgage Law and the Bankruptcy Law, thus confusing stakeholders. The Bankruptcy Law provides a time limit of 2 months or 90 (days) after the bankruptcy decision is given and must be given to the Curator. but it is felt that it does not provide sufficient time for the Creditor of the Mortgage Holder. Because the creditor rights holders have protected their rights by the Mortgage Law which is written in article 21 of the Mortgage Law. 摘要
本文的目的是为了克服未来的问题,1996年关于土地抵押和与土地有关的物品的第4号法和2004年关于破产和延期偿还债务的第37号法。预防性和抑制性的法律保护行为,却产生了对期限的规定的问题或法律冲突,这是《抵押法》与《破产法》之间问题的根源,从而使利益相关者感到困惑。《破产法》规定,破产决定作出之日起两个月或者九十日为期限,并必须提交管理人。但认为没有为抵押持有人的债权人提供足够的时间。因为债权持有人的权利受到《抵押法》第二十一条规定的《抵押法》的保护。在2个月内,并不意味着债权人必须完成执行,而是在该期限内债权人已经开始执行程序。由于抵押持有人必须通过出售抵押对象的过程。引用方式:Risvian, MK., Widhiyanti, HN dewanara, R(2022)。Perlindungan hukum债权人yang memegang hak tanggungan dalam kepailitan。中华医学杂志,13(1)。doi: 10.26905 / idjch.v13i1.7438。
