In answering these problems, this paper uses a normative method by collecting data from literature studies in the form of labor law regulations in Indonesia, doctrines, and court decisions. The results of this study are that work agreements may use exoneration clauses with limitations that do not differ from Article 1320 KUHPER jo. 摘要

免责条款是指由于工作协议中地位更占优势或更高的一方是雇主,其内容更有利于地位较高的一方,从而使该免责条款对地位低于雇主的工人造成伤害的条款,尽管协议承认合同自由原则,但并没有明确限制在工作协议中使用免责条款。为了回答这些问题,本文采用规范性方法,从文献研究中收集数据,以印度尼西亚劳动法法规,学说和法院判决的形式。本研究的结果是,工作协议可以使用免责条款与限制,不不同于第1320 KUHPER工作。《劳动法》第52条和受劳动协议免责条款损害的劳动者的法律保护,可以进行三方或调解,对劳动协议进行补充/修改,或者劳动者对免责条款所包含的劳动协议与劳动协议的效力条款不一致的,可以向法院提出解除劳动协议。
