ABSTRACT: Building on the development of critical legal history begun in the 1980’s as a radical alternative to traditional historiography, this essay reflects the decisive role that our conceptualization of law has on our “historian’s rep-resentation” of what counts as law in each case. Against this background, this article proposes an approach to the law as a dimension of culture, foreign to any apriorism, and identifies the main theoretical challenges that this poses to the current situation faced by legal historiography – characterized by the dialectic between globalization and localization.
