HUBUNGAN ISLAM DENGAN SISTEM PERADILAN DI INDONESIA
- Islam is a universal religion in its teachings. Islamic law has a goal or maqasid sharia to create benefit for its people. As a predominantly Muslim country, Islamic law has an important relationship with the judicial system in Indonesia, including in building the existing justice system in Indonesia. With the presence of Islam in the justice system in Indonesia, it is necessary to look at the relationship between Islam and the judicial system in Indonesia and the achievement of maqasid sharia in the justice system in Indonesia. By exploring the judicial system in Indonesia, the textual arguments, and the views of scholars in the field of justice, the author finds a relationship between Islam and the judicial system in Indonesia. The history of the judicial system in Indonesia has never been separated from the role of Islam, although not as a whole. The principles of the judicial system that exist in Indonesia to achieve the objectives of judicial power have conformity with the objectives of maqasid sharia. The application of these principles by the judiciary determines the realization of these goals, namely law enforcement and justice.
