The research method used is a normative juridical research method, which is a study of a norm of legislation and legislation both historically, systematically, comparatively, synchronization, and on general legal principles. 摘要
本研究旨在分析宪法法院第012/PUU-I/2003号判决适用于最高法院第112 K/ pdt - su - phi /2017号判决书和第140 K/ pdt - su - phi /2017号判决书后,因重大错误而终止雇佣关系的实施情况。所采用的研究方法是规范法学研究方法,即对立法规范和立法规范进行历史的、系统的、比较的、同步的、一般法理的研究。根据宪法法院第012/PUU-I/2003号关于因严重错误而终止雇佣的决定,由于存在2015年12月29日的“2015年最高法院全体会议结果制定的执行情况作为法院履行职责的指导方针”的2015年第03号最高法院通函而未执行的决定,字母B,《特别民法典》(e)第2条规定:“根据2003年《人力法》第13号第158条(2004年10月28日宪法法院第012/ puu - 1 /2003号判决),因严重错误而解雇职工的情况下,无需等待具有永久法律效力的刑事判决,即可进行解雇。”
