This article uses normative legal research methods. The sources of data used are secondary sources of data which include primary and secondary legal materials. The method of collecting legal materials is carried out by means of a literature study. The analysis of legal materials used is carried out prescriptively through a statutory and conceptual approach. The results of the study concluded that the characteristics of flat ownership certificates by foreign nationals are regulated in the Basic Agrarian Law whose regulation cannot be separated from the principle of land attachment, besides that it is also regulated in the Law on Flat Units. 摘要

本研究旨在从社会正义的角度,分析外籍公民拥有的单位所有权证书的特点,以及在《创造就业法》的规范下,其实施情况。本文采用规范的法学研究方法。所使用的数据来源是二级数据来源,包括一级和二级法律材料。法律资料的收集方法是通过文献研究的方式进行的。所使用的法律材料的分析是通过法定和概念的方法进行的。研究结果显示,除《单位法》外,《基本土法》亦对外国人居屋证明书的特点作出规管,而《基本土法》的规管离不开土地附着物原则。根据《创造就业机会法》规定,对在国有土地上建设的外国人公寓实行所有权证书制度,不符合公平分配土地的原则。
