The article proposes to proceed from the fact that in order to recognize the acquirer as good faith, it is sufficient to have no doubts about the legal basis for acquiring the rights of the alienator to the thing. The imposition on the acquirer of the burden of verifying the powers of the person from whom the alienator acquired the thing is an excessive burden for an ordinary participant in civil turnover. 《俄罗斯联邦民法典》第302条保护受让人,受让人在取得物品时不知道也不可能知道受让人的违法性。知道受让人对物的权利是保护受让人的条件之一。与此同时,收购方所掌握的知识的数量和内容是否有资格认定其为尽职尽责的问题是有争议的。本文建议从承认受让人对物的权利取得的法律依据不存在疑义这一事实出发,以证明受让人的善意。对一般民事交易参与人来说,受让人有责任核实让与人向其取得物品的人的权力,这是一种过重的负担。就不动产而言,如果让与人的权利已在国家不动产登记簿上登记,除非买受人知道第三人对不动产客体的正当主张,否则必须视为善意。
