摘要

研究目的是为未在知识产权总局注册的中小微企业产品提供保护。运用基于立法方法和概念方法的规范研究。通过本研究,作者提出了品牌在中小微企业中的重要性,以及中小微企业未注册产品的保护。印尼有很多中小微企业,而且中小微企业在印尼经济中非常有影响力。印尼的中小微企业不仅在国内发展,在国外也非常发达。印尼中小微企业的数量也导致了许多产品和品牌的出现。一个中小微企业与另一个中小微企业可能没有相同的品牌名称。如果有问题,那么在这种情况下,谁首先使用品牌名称将是一个问题。印度尼西亚的构成制度在商标权方面缺乏法律确定性,应采用“证明商标已在贸易活动中使用”和“愿意在贸易活动中使用”的法律保护。中小微企业必须认识到商标保护的重要性,政府必须对商标注册进行社会化
