Problems of participation of the head of the investigative body in proving: analysis of the results of the survey of employees of the Investigative Committee of Russia

Автор представляет к рассмотрению актуальные результаты проведенного в 2022 году анкетирования действующих сотрудников Следственного комитета Российской Федерации по вопросам участия руководителя следственного органа в доказывании по уголовным делам. Эмпирическим исследованием охвачены вопросы самостоятельности и независимости следователя, его взаимодействия с курирующим руководителем, соотношения контрольных полномочий руководителя и надзора прокурора, участия руководителя в доказывании, в частности в оценке доказательств по уголовным делам. В рамках анкетирования опрошено 520 должностных лиц следственных управлений по Тульской, Тверской, Орловской, Калужской, Курганской, Магаданской, Смоленской, Ярославской, Амурской областям, а также следственных управлений СК России на транспорте. В работе проанализированы мнения и позиции следующих репрезентативных групп: следователей и руководителей следственных органов районного/городского звена и отделов по расследованию особо важных дел, сотрудников контрольно-следственных отделов и подразделений криминалистики. Проведены выборки ответов в зависимости от стажа службы опрошенных. Итоговые выводы по ключевым вопросам представлены в виде наглядных и удобных для восприятия диаграмм. Полученные результаты объективны и достоверны, могут быть использованы исследователями при рассмотрении проблем, связанных с осуществлением процессуального контроля и процессуального руководства, а также уголовно-процессуального доказывания. The author presents for consideration the current results of a survey conducted in 2022 of the current employees of the Investigative Committee of the Russian Federation on the participation of the head of the investigative body in proving in criminal cases. The empirical study covers the following issues: the autonomy and independence of the investigator, his interaction with the supervising head, the ratio of the supervisory powers of the head and the supervision of the prosecutor, the participation of the head in proving and, in particular, the assessment of evidence in criminal cases. As part of the survey, 520 officials of the investigative departments of the Tula, Tver, Oryol, Kaluga, Kurgan, Magadan, Smolensk, Yaroslavl, Amur regions, as well as the investigative departments of the Russian Investigative Committee for transport were interviewed. The paper analyzes the opinions and positions of the following representative groups: investigators and heads of investigative bodies of the district / city level and departments for the investigation of particularly important cases, employees of control and investigation departments and forensic departments. Sampling of responses was carried out depending on the length of service of the respondents. The final conclusions on key issues are presented in the form of visual and easy-to-read diagrams. The results obtained are objective and reliable, they can be used by researchers when considering problems related to the implementation of procedural control and procedural guidance, as well as criminal procedural proof.
