The results show that the causes of land dispute between Gamsungi and Tosoa villages due to: a). The arrival of ex-refugees from Lata-lata village in South Halmahera regency, b). Land expropriation and/ or land disposal by ex-refugees of Lata-lata village to the agricultural field of Gamsungi villagers, and c). Felling of plants in the agricultural field of Gamsungi villagers done by Lata-lata refugees. Therefore, the mechanism or way of settling land disputes between these two villages is through negotiation (consensus). 摘要

本研究旨在厘清西哈马黑拉县南伊布区Gamsungi村民与Tosoa村民土地纠纷的成因及解决方法。本研究采用定性描述方法,即根据现有事实,通过描述研究对象目前的状态来解决所调查的问题的一系列程序。使用的数据源是主要数据和次要数据。而数据收集的技术主要是观察法、文献访谈法和辅助数据法。结果表明,导致Gamsungi村与Tosoa村土地纠纷的原因有:a)来自南Halmahera县Lata-lata村的前难民的到来,b) Lata-lata村的前难民对Gamsungi村村民的农田进行了土地征收和/或土地处置,c) Lata-lata村的难民砍伐了Gamsungi村农田中的植物。因此,解决两村土地纠纷的机制或方式是通过协商(共识)。两个村的代表(Gamsungi村和Tosoa村):两个村的村长、秘书、习惯人物、宗教领袖和BPD的负责人进行了谈判,并由南伊布街道负责人、西哈马黑拉刑事调查股负责人、西哈马黑拉政府代表、伊布警察局长、Sambung Rasa队和伊布的Koramil见证。
