Some theoretical and practical issues of applying the prohibition of certain actions in criminal proceedings

The article discusses some of the problems that arise when applying a preventive measure in the form of a ban on certain actions. The authors draw attention to the shortcomings of the current system of preventive measures. Federal Law No. 72-FZ of April 18, 2018 "On Amending the Code of Criminal Procedure of the Russian Federation with regard to the selection and application of preventive measures in the form of a ban on certain actions, bail and house arrest" amended Article 98 of the Code of Criminal Procedure of the Russian Federation, namely, adding an addition to paragraph 4.1, dedicated to the prohibition of certain actions, and adding a new article - article 105.1, also devoted to the prohibition of certain actions. The authors took as a basis for the bill the construction of Article 107 of the Code of Criminal Procedure of the Russian Federation. In addition, when developing, they took into account the experience of using house arrest. It is worth noting that it is this measure that occupies a leading position among all other measures that are elected in court.
