The first part of the paper deals with a definition of originality, having a special focus on the „author’s own intellectual creation“ – standard which has significantly harmonized EU copyright law throughout the last decade. In the second part of the paper the author explores if it is justified to protect every original work as a work of authorship, having in mind the low standard of protection. The author confronts the scope of the right with the number of eligible subjects of protection in the everyday life and lists some examples on lack of copyright protection for works which are certainly original.
