Agricultural enterprises and farms do not have land owned. Instead, the peasants who became owners of land during the distribution of collective farms, mostly do not process these parcels of land on their own, but also deprived of the right to alienate them (to sell, give, change). The study shows the development of leased land use of agricultural enterprises in Ukraine, which currently covers 16.8 million hectares of private land and about 1 million hectares of state-owned land. Since 2003, the civil law of Ukraine permitted to apply not only the lease of agricultural land, but also the emphyteusis right (the alienated right to use someone’s land for agricultural purposes), the process of transformation of lease into emphyteusis was started, especially in large agricultural holdings. The main advantages of emphyteusis as a substantive law and its attractiveness for agribusiness are considered. 摘要

乌克兰农业用地市场长期存在法律限制的结果是形成了一种特定的土地使用租赁制度。农业企业和农场没有土地所有权。相反,在集体农场分配过程中成为土地所有者的农民,大多没有自己处理这些土地,但也被剥夺了转让这些土地的权利(出售、赠送、更换)。该研究显示了乌克兰农业企业租赁土地使用的发展情况,目前包括1680万公顷的私人土地和约100万公顷的国有土地。自2003年以来,乌克兰民法不仅允许农业用地租赁,还允许土地使用权(将某人的土地用于农业目的的让与权),开始了将租赁转为土地使用权的过程,特别是在大型农业控股中。本文分析了企业法作为实体法的主要优势及其对农业企业的吸引力。最后,提出了完善国有条件下土地利用法律规制的建议。
