Critical Observations on the Draft Transnational Rules of Civil Procedure

Abstract

This article examines the draft "Transnational Rules of Civil Procedure." It argues that the draft Rules suffer from significant shortcomings and should not be adopted. Among other things, the draft Rules are biased against local litigants, in favour of international litigants, and unjustifiably treat similarly-situated litigants in disparate ways.
