PERAN MAJELIS DUDUK SETIKAR KAMPUNG DALAM MENYELESAIKAN SENGKETA DI KECAMATAN RANTAU KABUPATEN ACEH TAMIANG

Abstract

The purpose of this writing is to examine the role of MDSK in resolving disputes that arise in society and the obstacles and solutions to MDSK in resolving disputes that arise in society. The use of this research method is empirical juridical where applicable legal provisions are linked to the reality that occurs in society. The results of this study indicate that the role of MDSK is part of a customary institution that carries out customary justice with the task of resolving disputes in society with customary stakeholders. MSDK's obstacle in resolving disputes is the unclear reference to the legal basis for MDSK's duties with obstacles in field implementation such as the absence of a lack of understanding between MDSK and Adat Stakeholders, multiple positions of MDSK members, disputes that occur into the money industry and less harmonious relations between the Village Government and MDSK. The solution for MDSK is to strengthen coordination of understanding between MDSK and customary stakeholders, carry out socialization or dissemination to the community about village-level dispute resolution, training MDSK in resolving disputes and improving the relationship between MDSK and Village Government.
