The new norm decriminalised same-sex activity between adults, but specifically punished acts committed on minors (under twenty years old), abuse of distress, and homosexual prostitution. The goals were, inter alia, to avoid scandal and cases of blackmail, as well as suicides. In addition, the law sought to prevent the development of an activist movement as highly visible as the one witnessed in Germany before the Nazis’ rise to power. francaisLa construction de l’article sur la « debauche contre nature » dans le Code penal suisse de 1942 permet d’analyser les influences entre les experts juridiques et les psychiatres, ainsi que la formation d’un consensus entre les traditions criminelles francaises et allemandes. La nouvelle norme depenalise les actes sexuels entre adultes du meme sexe, mais punit specifiquement les actes commis sur des moins de vingt ans, l’abus de detresse et la prostitution homosexuelle. Les buts sont d’eviter des scandales et des chantages, voire le suicide des concernes, entre autres.
