Abstract

El presente artículo analiza la forma en que la Sala Civil de Casación Civil de la Corte Suprema de Justicia realizó la liquidación del lucro cesante con acrecimiento en la sentencia SC4703 del 22 de octubre de 2021, y se pondrán de presente las imprecisiones: omisión de aplicación del acrecimiento durante el lucro cesante consolidado y el equivocado descuento de gastos personales cuando solamente reclama una víctima indirecta, todo lo cual generó un enriquecimiento para la víctima.
