Abstract
The attitude of European states towards asylum seekers is in restraining overall. The review of the European rules on asylum and a brief review of the judgments of the European Court of Human Rights and the Court of Justice, show the human rights violations that have been performed in order to limit the access of asylum seekers in European countries. The recent inflows, deemed exorbitant, resulted, after an attempt to cooperation then in fact failed, in the enactment of more stringent rules with major violations of rights. Finally, the agreement with Turkey marks the partial renunciation by Europe to handle the problem, which is delegated to a country that offers few guarantees of democracy and respect for human rights.
