La seguridad social en América Latina desde un enfoque de derechos: evolución conceptual en el marco de acuerdos internacionales

Abstract

The purpose of this work is to determine how the conceptualization of the right to social security (its role, priorities and characteristics) and to social protection for older persons has been articulated and amended in legal instruments. To achieve this, an analysis is conducted of the content of human rights instruments, from the earliest to the most recent. The goal is to understand transformations in the concepts of who is the subject of the law, what rights should be guaranteed and which distributive justice criteria should guide the design of systems for transferring income to older persons. The results of the study highlight increasing tensions between contributory social security and the criteria of universal access and equitable distribution of social rights in old age, which are explored in greater depth in international legal instruments.
