The article, based upon a theoretical research and presented as an essay, aims at interpreting Brazilian contemporary context, under which democracy and constitutionalism wither away. Firstly, a theoretical review is accomplished, in order to define the category neo-liberalism, as well as to justify its adoption to depict Brazilian reality.
