EnglishAbstract In this article we will study the evolution of the contract of mandate in relation to its gratuitousness or valuable consideration in the thought of Andres Bello. To attain the purposes of this investigation, an analysis of the thought of Andres Bello, concretely his viewpoints on the matter as portrayed on his “Instituciones de derecho romano” and “Esplicaciones de derecho romano” is proven necessary. In said works, faithful to the civil law tradition, he stated that the contract of mandate was, in essence, gratuitous. espanolResumen En el presente articulo se estudia la evolucion del contrato de mandato en el pensamiento de Andres Bello, con respecto a la gratuidad u onerosidad del mismo. Para lograr los propositos de esta investigacion, es necesario analizar el pensamiento de Andres Bello concretado en sus “Instituciones de derecho romano” y en sus “Esplicaciones de derecho romano”. En dichas obras, en forma fiel a la tradicion romanista, se indico que el mandato por esencia era gratuito. Tambien se estudia el derecho civil frances y especialmente los diversos proyectos de Codigo Civil de Chile, con el objetivo de determinar el momento en que se admitio su onerosidad.
