Se tomaron en cuenta elementos dogmaticos de caracter constitucional y penal sobre las disposiciones normativas que protegen el honor frente al ejercicio ilegitimo de la libertad de expresion. Este marco permitio analizar el contenido conceptual del interes publico en relacion con la libertad de expresion. Este es uno de los criterios mas destacados para la despenalizacion de conductas que lesionan el honor, donde la difusion de informacion y opinion son de especial relevancia para el despliegue del proceso democratico y los derechos fundamentales en un Estado constitucional. En una primera etapa, los proyectos de ley evaluados denotan una adhesion debil al rol del interes publico para fortalecer las premisas deliberativas del proceso democratico. Tampoco discutieron adecuadamente el contenido protegido del derecho al honor y su proteccion a traves de vias alternativas. Estas limitaciones mejoraron en la etapa mas reciente del debate, lo cual denota un mayor interes argumentativo en la aplicacion del interes publico como criterio normativo para fundamentar la despenalizacion en concordancia con los deberes de motivacion de un legislador racional. EnglishThis article analyses the application of the public interest in the reasoning of the Peruvian legislator for the decriminalization of crimes against honour. Dogmatic elements of a constitutional and criminal nature were taken into account on the normative provisions that protect honour against the illegitimate exercise of freedom of expression. This framework made it possible to analyse the conceptual content of the public interest in relation to freedom of expression. This is one of the most prominent criteria for the decriminalization of conduct that damages honour, where the dissemination of information and opinion are of special relevance for the deployment of the democratic process and fundamental rights in a constitutional State. In a first stage, the bills evaluated show a weak adherence to the role of the public interest to strengthen the deliberative premises of the democratic process. Nor did they adequately discuss the protected content of the right to honour and its protection through alternative means.
