COMPARATIVE LEGAL METHOD IN CIVIL THESES

Abstract

dialectical and formal logics were used, especially methods of analysis, synthesis and comparison, as well as the juridical dogmatic method of cognition. Results: on the basis of approaches, principles and rules developed by the doctrine of comparison, a “roadmap” was defined for using the comparative legal method in thesis works: formulation of purpose of addressing the foreign experience of legal regulation; choosing the legal system for comparison; understanding the contents of the foreign law norms; discovering similarities and differences in legal regulation; comments, critical examination and execution of the results obtained from comparison.
