(IN)DIGNIDADE HUMANA NA SOCIEDADE CONTEMPORÂNEA: ESTERILIZAÇÃO COMPULSÓRIA NO CASO JANAÍNA

Abstract

The general objective of the research is to investigate the exercise of private autonomy and self-determination, corollaries of human dignity, to critically analyze the Janaína case. The choice of the theme is justified due to its practical, legal and constitutional relevance, especially with regard to the State’s right to intervene in the private sphere of individuals. The dignity of the human person involves several interpretations that border ambiguities, providing the use of the principle as a mechanism for using heteronomy. Thus, we analyze the factual situation involving Janaína, a homeless woman who had her sterilization performed compulsorily, to demonstrate that the best reading of human dignity is based on the understanding of people as moral agents, who have the capacity for self-determination to choose the direction of your own life. Through bibliographic and documentary research, the use of the deductive method and critical, thematic and interpretative analyzes, it was concluded that judicial discretion and meta-legal arguments aprioristically legitimized state intervention to prevent Janaína’s right to reproduce, in contradiction with the fundamental right of freedom, self-determination and human dignity.
