Abstract

How to judge the formation of Malicious Incompatibility is a problem that cannot be circumvented and is difficult to solve in the trial of new types of unfair competition on the Internet. 如何判断恶意不相容的形成,是互联网新型不正当竞争行为审判中难以回避和解决的问题。修订后的《反不正当竞争法》虽然明确将恶意不相容规定为不正当竞争,但并没有提供一套明确的判断标准。德国和美国针对互联网发展中出现的新的不正当竞争纠纷,分别制定了完备的法律法规和裁判规则,为中国提供了很多可借鉴的审判思路。本文通过收集和分析以往案件的裁判文书和审判思路,以法律中恶意与不相容的内在逻辑为中心,试图从主观目的和行为所造成的客观效果的角度出发,运用价值衡量的方法,判断该行为是否构成恶意不相容。
