portuguesAs maiores exigencias de competitividade das empresas, no contexto global, temse repercutido, de sobremaneira, na organizacao economica da nossa sociedade, tendo surgido uma quantidade nunca antes vista de novos projetos de inovacao a tentar ganhar a sua quota de mercado. No mesmo sentido, a revolucao tecnologica, nossa contemporânea, tem demonstrado uma verdadeira forca transformadora de fenomenos existentes e exploradora de espacos desconhecidos e novos paradigmas, fazendo-nos questionar e reconsiderar os nossos principios, regras e a nossa concecao do modelo de convivencia social, numa otica de contribuir, colaborar e comunicar de forma a arranjar melhores solucoes para um mundo, que se tornou tao pequeno. Com base no exposto, procuraremos neste artigo analisar juridicamente o novo paradigma oferecido pela tecnologia blockchain e pelas criptomoedas e, em especifico, as repostas regulatorias a este novo e desafiante mercado, tendo em vista aprofundar os conhecimentos sobre os mecanismos flexiveis e dinâmicos de regulacao como a Soft Law e a autorregulacao. EnglishThe greater demands of competitiveness between companies, in the global context has overly affected the economical organization of our society, where an unprecedented number of innovation projects have emerged, trying to gain its market share. In the same vein, the technical revolution has shown a real transforming force of existing realities and a discoverer of unknown places and new paradigms, makings us question and reconsider our principles, rules and our conception of social living, from the perspective of contribution, collaboration and communication to improve the world that has become so small. On the basis of the above, we intend with this essay to conduct a legal analysis of the new paradigm offered by the blockchain technology, the cryptocurrencies and, in specific, the regulatory responses to this new and challenging market, taking into consideration the deepening of the awareness of the flexible and dynamic mechanisms of regulation, such as Soft Law and auto-regulation.
