Abstract
Retaliation claims are often raised when discrimination based on protected status isn’t a viable claim. When an institution of higher education has to take action against a student, an employee, or even a community member, the institution often evaluates whether the action could be viewed as (or is) discriminatory on the basis of a person's immutable characteristics.
