Abstract
Seventeen states have filed a lawsuit in the Eastern District of Texas against the secretary of the U.S. Department of Health and Human Services and HHS asking the court to strike down the new HHS 504 regulations and to declare that Congress did not have the authority to enact Section 504 of the Rehabilitation Act. Students with disabilities and postsecondary educational institutions will need to monitor this lawsuit for its impact on Section 504 as a whole and any changes to U.S. Department of Education Section 504 regulations.
