Abstract
Este análisis se adentra en las distintas interpretaciones de la figura del litigante en el ámbito jurídico mexicano, refutando la noción errónea de que un abogado es automáticamente un litigante. Se destaca la importancia de la distinción entre el titular del derecho y su apoderado, remontándose a la literatura jurídica mexicana del siglo XIX. Se cita el Reglamento de 1826, las Lecciones de Práctica Forense Mejicana de Manuel de la Peña y Peña, y otras obras de la época para respaldar la idea de que el litigante es siempre el titular del derecho en cuestión, pudiendo o no ser el cliente del abogado que actúa como su patrono en el procedimiento.

The Revista de Derecho Privado is a semi-annual publication that compiles the results of the investigative efforts, researches and articles written by professors and jurists from national and foreign universities, that are of interest to the legal community.
