Abstract
: The joint disciplinary system for credit default is an important component of the current construction of the integrity system in Chinese society. It plays a role in social credit management and has achieved significant results in practice. This paper, from the perspective of institutional effectiveness, analyzes the problems of the joint disciplinary mechanism for credit default, including incomplete supporting laws, imperfect legal procedures, inadequate standard systems, and information sharing mechanisms, as well as narrow channels for remedies. Drawing on the experience of joint disciplinary measures for credit default in the United States, the paper proposes improvement strategies and suggestions, including clarifying the legal procedures for credit default punishment, improving the credit standard system, enhancing the credit information sharing mechanism, optimizing credit repair and objection mechanisms, and so on.
