Abstract

With the development of big data and the rapid changes in technology, artificial intelligence has gradually become involved in our daily lives, and has even become an indispensable tool for contemporary young people. At present, the forms of artificial intelligence are gradually diversifying, and in this regard, a series of related legal issues have arisen. 人工智能在民法中的主体地位
随着大数据的发展和科技的日新月异,人工智能已经逐渐融入到我们的日常生活中,甚至成为当代年轻人不可或缺的工具。目前,人工智能的形式正在逐渐多样化,而在这方面,一系列相关的法律问题也随之产生。以今天的科技水平和机器人的自主程度来说,人工智能应该是对象,也就是作为民法对象,但是有多位科学家预测,在未来十年甚至几年的时间里,人工智能可以达到人类智能的80%,所以此时,强人工智能能否以民法主体的身份从事各种行为并承担相应的责任是讨论的重点。本文将从五个角度分析人工智能的发展现状、其对民法的挑战、其法律地位的争论、其法律主体地位的可行性以及国外法律规制和司法实践对中国立法的意义,探讨人工智能作为现代或未来本质存在的法律属性类型。
