On the current state of legislation in the field of protection personal data (based on the materials of the Republic of Kazakhstan)

По оценкам специалистов в области информационной безопасности, в Республике Казахстан в 2018–2020 годах из баз данных государственных органов и негосударственных организаций, осуществляющих сбор и обработку персональных данных, произошла утечка более 11 миллионов записей с личной и платежной информацией пользователей. В последующие годы ситуация в данной сфере продолжает оставаться сложной, в том числе в результате активной цифровизации казахстанского общества. В рейтинге ООН Global E-Government Development Index Республика Казахстан занимает 28 место по развитию электронного правительства. В Центральной Азии Казахстан является ведущей страной по этому показателю. В статье рассматривается история возникновения и становления, текущее состояние нормативных правовых актов Республики Казахстан в сфере защиты персональных данных, а также законодательства, предусматривающего ответственность за их нарушение. Кроме того, исследована история возникновения права на защиту персональных данных в европейских государствах и странах СНГ. По результатам установлены нормы законодательства, регулирующие вопросы защиты персональных данных и восстановления прав в случае нарушения законодательства в сфере персональных данных. При этом, несмотря на достаточное законодательное урегулирование этих вопросов в Республике Казахстан, обращено внимание на целесообразность дальнейшего совершенствования правовой базы в этом направлении, в том числе путем присоединения Казахстана к международным договорам. According to experts in the field of information security, in the Republic of Kazakhstan in 2018–2020, more than 11 million records with personal data and payment information of users were leaked from the databases of state bodies and non-governmental organizations that collect and process personal data. In subsequent years, the situation in this area continues to be difficult, including the consequences of the active digitalization of Kazakhstan society. In the UN Global E-Government Development Index, the Republic of Kazakhstan ranks 28th in e-government development. In Central Asia, Kazakhstan is the leading country in this indicator. The article discusses the history of emergence and formation, the current state of the regulatory legal acts of the Republic of Kazakhstan in the field of personal data protection, as well as legislation providing for liability for their violation. In addition, the history of the emergence of the right to protection of personal data in European states and CIS countries has been researched. Based on the results, legislative norms have been established to regulate protection of personal data and restoration of rights in case of violation of legislation in the field of personal data. At the same time, despite the sufficient legislative regulation in the Republic of Kazakhstan, attention was drawn to the advisability of further improving the legal framework in this direction, including joining Kazakhstan to international treaties.
