Legal protection of symbols of military glory of the Russian Federation

Abstract

В статье освещается актуальность и необходимость всестороннего изучения состояния законодательства в сфере правовой защиты символов воинской славы РФ. Авторами поднимается проблема отсутствия в действующем законодательстве фиксированного перечня символов воинской славы, в связи с чем предлагается свой перечень символов воинской славы. Также рассматриваются составы правонарушений, подразумевающих деяния, направленные против символов воинской славы, а также перспективы развития уголовной политики государства в отношении охраны символов воинской славы. Защита символов воинской славы в современных условиях должна быть максимально тщательно проработана. В этих целях авторы предлагают закрепить единый и исчерпывающий перечень данных символов, установить, что будет пониматься под «осквернением символов воинской славы». Представляется, что степень общественной опасности совершения подобных преступлений выросла в условиях ведения специальной военной операции на Украине, когда, защищая интересы нашей страны, ежедневно погибают российские солдаты. В этой связи предлагается ужесточить наказание за преступления, совершаемые в отношении символов воинской славы, а также снизить возраст уголовной ответственности для лиц, привлекаемых за совершение указанных деяний. The article highlights the relevance and necessity of a comprehensive study of the state of legislation in the field of legal protection of symbols of military glory of the Russian Federation. The authors raise the problem of the absence of a fixed list of symbols of military glory in the current legislation, and therefore, they propose their own list of symbols of military glory. The authors also consider the composition of offenses involving acts directed against symbols of military glory, as well as the prospects for the development of the criminal policy of the state in relation to the protection of symbols of military glory. The protection of symbols of military glory in modern conditions should be worked out as thoroughly as possible. To this end, the authors propose to consolidate a single and exhaustive list of these symbols, to establish more specifically what will be understood by “desecration of symbols of military glory”. It seems that the degree of public danger of committing such crimes has increased under the conditions of conducting a special military operation in Ukraine, when Russian soldiers are killed every day defending the interests of our country. In this regard, it is proposed to toughen the punishment for crimes committed against symbols of military glory, as well as to reduce the age of criminal responsibility for persons involved in the commission of these acts.
